These Terms of Service ("Terms") govern your access to and use of viegoco.com (the "Site") and any purchase you make from Viego Co. ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Products and Availability

We take care to describe and photograph products accurately. Colours, finishes and natural materials such as wood, rattan and brass may vary slightly between screens and between individual items; this variation is a characteristic of the material and is not a defect.

All products are subject to availability. We may change, limit or discontinue any product at any time. If an item you have ordered becomes unavailable, we will contact you and offer an alternative or a full refund.

Dimensions, wattages and specifications are provided as a guide. Where fit is critical, please check the measurements on the product page before ordering.

4. Sets and Room Kits

Room Kits and other sets are sold as a single product at a single price. The individual items in a set are not separately priced and cannot be part-returned for a partial refund under our change-of-mind policy; a change-of-mind return of a set means returning the whole set. This does not affect your rights where an individual item in a set arrives damaged, faulty or incorrect, or where a warranty claim applies — those are handled item by item under our Refund Policy.

5. Pricing and Payment

Prices are shown in US Dollars for United States customers and Pounds Sterling for United Kingdom customers. The price shown at checkout is the total you pay: it includes standard tracked delivery and any import duty or customs charge arising on your shipment, and nothing further is payable on delivery.

We reserve the right to correct pricing errors. If a product is listed at an incorrect price, we will contact you before dispatch and give you the option to proceed at the correct price or cancel for a full refund.

Payment is taken at the time of order through our payment providers. We do not store your full card details.

6. Orders and Acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt of your order but does not constitute acceptance. The contract is formed when we dispatch your order. We may decline an order — for example where we suspect fraud, where stock is unavailable, or where we cannot deliver to your address — and will refund you in full if we do.

7. Shipping, Returns and Warranty

Delivery is governed by our Shipping Policy. Returns, refunds and the one-year warranty are governed by our Refund Policy. Both form part of these Terms.

8. Product Safety and Correct Use

Our lighting and electrical products are intended for domestic use in the environment stated on the product page. Hard-wired fixtures should be installed by a qualified electrician and in accordance with local electrical regulations. Products rated for indoor use must not be used outdoors.

Fire pits, candles, lanterns and any product involving open flame must never be left unattended, must be used outdoors in a well-ventilated area away from flammable material, and must be kept away from children and pets. Follow the safety instructions supplied with the product.

We are not responsible for damage or injury resulting from incorrect installation, misuse, or use outside a product's intended purpose.

9. Intellectual Property

All content on the Site — text, product copy, photography, graphics, logos and design — is owned by Viego Co. or used under licence, and is protected by intellectual property law. You may not copy, reproduce, republish or use it commercially without our written permission.

10. Acceptable Use

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to any part of it, to interfere with its operation, or to extract data from it by automated means without our consent.

11. Customer Reviews and Submissions

If you submit a review, photo or other content, you grant us a non-exclusive, royalty-free licence to use, display and reproduce it in connection with our business. You confirm the content is yours to give and does not infringe anyone else's rights. We may remove content that is unlawful, misleading or offensive.

12. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for the products concerned.

We are not liable for indirect or consequential loss, including loss of profit, loss of use, or loss arising from delay in delivery.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. Your statutory rights as a consumer — including under the Consumer Rights Act 2015 in the United Kingdom and applicable state and federal law in the United States — are not affected.

13. Events Outside Our Control

We are not liable for delay or failure to perform caused by events outside our reasonable control, including natural events, industrial action, carrier failure, customs delay, and interruption to telecommunications or transport networks.

14. Changes to These Terms

We may update these Terms from time to time. The version in force at the time you place an order is the version that applies to that order. Changes take effect when posted to the Site.

15. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, and the courts of that state have jurisdiction.

If you are a consumer resident in the United Kingdom, this does not deprive you of the protection of the mandatory consumer laws of the United Kingdom, and you may bring proceedings in the courts of the United Kingdom.
